Welcome to JQMcinema. These Terms & Conditions govern your use of our website (jqm-cinema.com) and our boutique video production services. By accessing our platform or engaging JQMcinema for cinematic advertising assets, you agree to comply with and be bound by the following terms. We are committed to professional excellence and transparent collaboration.
1. Service Engagement
JQMcinema provides high-end cinematic advertising production. Each project is defined by a unique scope of work, project timeline, and delivery schedule. Work commences only upon the execution of a formal production agreement and receipt of the required initial deposit.
2. Intellectual Property
Unless otherwise stipulated in a clear written contract, JQMcinema retains ownership of all raw footage, project project files, and unused creative concepts. The client is granted an exclusive license to use the final delivered cinematic brand asset for its intended marketing purposes upon final payment.
3. Payment Terms
Payment structures are divided into phases: Securing Deposit, Post-Production, and Final Delivery. Full payment is required before final high-resolution masters are delivered. Late payments may result in production delays or additional administrative fees.
4. Cancellations & Rescheduling
Project deposits are non-refundable as they represent the reservation of production resources. Cancellations must be provided in writing. Any costs incurred for production, talent, or location scouting up to the cancellation date remain the responsibility of the client.
5. Client Responsibilities
The client is responsible for providing necessary brand assets, information, and timely approvals at each production phase. Delays in client feedback or resource provision may result in a shift of the final delivery date and potential rescheduling fees.
6. Usage & Licensing
The final cinematic advertisement is licensed for digital distribution and broadcast as defined in the project brief. Broader usage beyond the agreed-upon duration or territory may require additional licensing fees. JQMcinema reserves the right to include final works in its promotional portfolio.
7. Limitation of Liability
JQMcinema provides advertising production with high professional standards. However, we are not liable for the commercial performance of the advertisement or any indirect losses resulting from its use. Our total liability is limited to the amount paid for the specific project in question.
8. Confidentiality
Both parties agree to treat all non-public project information, pricing, and internal business strategies as confidential. This obligation extends beyond the completion of the project and applies to all JQMcinema employees and project-specific contractors.
9. Governing Law
These terms are governed by and construed in accordance with the laws of Ontario, Canada. Any legal proceedings arising from these terms or our boutique production services shall be resolved within the appropriate courts of the jurisdiction.
